Beyonce's lawyers have asked a judge to dismiss a bizarre lawsuit filed against the pregnant singer by the family of a late New Orleans, Louisiana comedian.
The suit suggests Beyonce illegally sampled a spoken word performance by Messy Mya in her Formation video.
The comedian's estate, led by his sister Angel Barre, filed legal papers in February (17), demanding royalties, damages and recognition, insisting the funnyman, real name Anthony Barre, be credited as a writer, composer, producer and artist on the track.
Barre can be heard saying, "What happened at the New Orleans", and, "B**ch, I’m back by popular demand", in the promo, and his sister claims the samples infringe the rights of two of her late brother's comedy works. His voice does not feature in the audio version of the Lemonade album track.
In a new motion to dismiss, Beyonce's attorney Mary Ellen Roy argues Angel Barre has overstated the use of her brother's work in the Formation video, insisting it amounts to just 10 seconds, and falls within the protection of the fair-use doctrine.
Furthermore, Roy states: "While beyond the scope of this motion, Pretty Bird (production company) licensed the YouTube Videos from Mr. Barre’s family before plaintiff Angel Barre had herself appointed as the administrator of the Estate of Anthony Barre weeks after the Music Video’s premiere - presumably for the purpose of bringing this action."
Beyonce isn't letting the legal drama get her down - the pregnant star was spotted celebrating Easter with her mother Tina Knowles and best pal Kelly Rowland over the weekend (15-16Apr17).

Pop superstar Beyoncé has recorded a collaboration with British rockers Coldplay.
The Irresistible singer headed to the studio with Chris Martin's band to record a track for their new album A Head Full of Dreams, which is due for release in December (15).
The duet follows the band's previous collaboration with Rihanna, Princess of China, which featured on Coldplay's 2011 record Mylo Xyloto.
British rocker Noel Gallagher, Swedish singer Tove Lo, and gospel star Merry Clayton also feature in tracks on A Head Full of Dreams.
"Coldplay has never enjoyed making a record more than this one. Nor have they been happier with the results," a statement from the band's Parlophone record label reads.
They premiered the album's first single, Adventure Of A Lifetime, on Friday (06Nov15), and the rockers made an appearance on British radio station BBC Radio 1, revealing they came close to missing their deadline for the record, which they completed three weeks ago.
"It (the deadline) gradually moved later and later - but we came in relatively on time," explains Chris. He also reveals the record is much more cheerful than their last offering, 2014's Ghost Stories, saying, "(It is) a more colourful, more joyful sort of thing... It's the sound of us being free and happy and very grateful to be in our group."
The frontman also revealed he is hoping the new album will be a success and land them their first ever headline appearance at Britain's Glastonbury festival next year (16)."We'd love to do it. Lane spande vorig jaar een zaak tegen Beyoncé aan omdat hij vond dat ze plagiaat heeft gepleegd door af te kijken bij zijn nummer XOXO. Hij eiste 3 miljoen dollar, maar donderdag kreeg hij van een rechter te horen dat hij niet hoeft te rekenen op dat bedrag. Een New Yorkse rechter meldde namelijk dat de twee liedjes muzikaal en tekstueel niet op elkaar lijken. Bovendien is Lane's nummer rauw en expliciet seksueel en de single van Beyoncé niet, die is juist "mild en romantisch", zo klonk het oordeel.
De zanger claimde aanvankelijk dat hij zijn nummer liet horen aan een zangeres die veel samenwerkt met Beyoncé. Even later bracht Beyoncé haar nummer XO uit en volgens Ahmad lijkt dat wel heel erg op zijn liedje. (Bron: HLN)
